Landlord Privacy Notice
1 Players Land Limited (“Landlord”, “we”, “us”, “our”), is a "Controller" under the General Data Protection Regulation ((EU) 2016/679) ("GDPR") in respect of certain Personal Data you furnish to us as tenant of the Property. This Privacy Notice is intended to help you understand what Personal Data we collect about you, why we collect it, and what we do with it.
“Data Protection Law” means all applicable data protection law, including the General Data Protection Regulation and the Data Protection Acts 1998, 2003 and 2018, and any legislation which amends, extends, consolidates, re-enacts or replaces same, including any statutory instruments and regulations that may be made pursuant thereto from time to time; and
“Personal Data”, shall have the meaning set out in Data Protection Law.
1. The type of Personal Data collected and processed
We collect and process Personal Data relating to you as follows:
- your name and contact details, including your email address and address and phone number;
- your PPS number;
- your job title and the company you work for;
- educational or employment background and details or current and former positions, CVs and references;
- a copy of official photographic identification, including passport or identification cards;
- images of you when inadvertently recorded by the operation of CCTV at Alta Verde;
- your financial details including details about your bank account;
- vehicle registration details;
- pet licences;
- user IP address and your use of the managed broadband network or other online identifier;
- service /utility metering;
- data relating to breaches of the Agreement;
- tenant notices served or received under the Agreement;
- car rental data and data regarding access to amenities at Alta Verde;
- parcel delivery;
- details of any accidents or other incidents on estate that may be relevant to you or details required to manage health and safety risks, insurance and legal obligations;
- Data subject access request details; and
- any other personal data relating to you that you provide us or that we generate about you in connection with your relationship or interactions with us.
2. Purposes of processing and legal basis
The purposes for which your Personal Data may be held and processed are:
(a) to perform our contractual obligations with you;
(b) to comply with our legal obligations;
(c) establishing, exercising or defending legal claims;
(d) contacting you to serve notices or communications under the Agreement or to respond to any communications you might send to us;
(e) necessary for the management and regulation of the Estate;
(f) for the purposes of our legitimate interests; and
(g) the processing is necessary to protect your interests or those of another.
Our legal basis for collecting and using this information in accordance with the provisions of this Data Privacy Notice is:
(a) that it is necessary for the performance of a contract with you;
(b) that it is necessary for compliance with a legal obligation that applies to us; or
(c) that you have provided consent to us for the use of your Personal Data.
You can withdraw it at any time by informing the Landlord in writing, however, this will not affect the lawfulness of processing which was carried out based on your consent prior to its withdrawal.
3. Recipients of Data
We may disclose your personal data to third party recipients in connection with the above purposes, including to:
- affiliates or members of our corporate group;
- third parties who we engage to provide services to us, such as the Landlord’s Agent or to you or who provide services to the Estate, such as outsourced service providers, IT services providers, building and maintenance contractors, security companies;
- third parties including valuers, investors, fund managers, law firms, accountants, estate agents or other agents who act on our behalf for the management of Estate;
- insurance brokers and providers, lenders and lender project managers and consultants;
- to the Landlord’s Agent;
- to third parties, their agents and professional advisors, subject to confidentiality obligations, in connection with any proposed merger, acquisition, re-organisation or transfer of our business or the estate (or any part thereof);
- to the Residential Tenancies Board;
- to competent regulatory authorities and bodies s where required or permitted by law, such as An Garda Síochána or other law enforcement authorities for the purposes of prevention, investigation or detection of crime; and
- to comply with any applicable law or regulation, a summons, search warrant, court or regulatory order, or other statutory requirement
4. Retention
We will not hold your Personal Data for longer than is necessary. We retain your Personal Data for as long as we need it for the purposes described in this notice, or to comply with our obligations under applicable law and, if relevant, to deal with any claim or dispute that might arise between you and us.
5. Necessity of provision of certain information and consequences
There are certain pieces of information that may be required so that we can perform the Agreement and ancilla agreements and comply with our obligations under applicable law, such as your bank account details for receipt of Rent and return of the Security Deposit, etc. If you do not provide us with this information, then we may not be in a position to continue dealing with you in compliance with our obligations and internal policies, or to perform tasks for your benefit.
6. International transfers of data
In order for the purposes outlined above and particularly for technical support, from time to time, we might have to transfer your Personal Data outside the European Economic Area (EEA) to a country that has not been confirmed by the European Commission to provide an adequate level of protection for Personal Data. If and to the extent that we do so, we will ensure that appropriate measures are in place to comply with our obligations under applicable law governing such transfers, which may include entering into a data processing agreement in respect of the transfer which contains the ‘standard contractual clauses’ approved by the European Commission, or in respect of transfers to the United States of America, ensuring that the transfer is covered by the EU-US Privacy Shield framework (or any replacement framework).
What this means is that, where we do not have the assurance of the destination for your data having been subject to a review by the European Commission, we will use other approved controls to ensure we can protect your data adequately and to ensure that those third parties who may process your personal data on our behalf meet the highest standards of privacy practices and comply with applicable data protection law.
7. How we secure your Personal Data
Where you communicate with us via the residents portal / website, the nature of the internet is such that we cannot guarantee or warrant the security of any information you transmit to us via the internet. No data transmission over the internet can be guaranteed to be 100% secure. However, we will take all reasonable steps (including appropriate technical and organisational measures) to protect your Personal Data.
8. Your personal data rights
You have the following rights, in certain circumstances and subject to certain restrictions, in relation to your personal data:
- Right to access the data – You have the right to request a copy of the personal data that we hold about you, together with other information about our processing of that personal data.
- Right to rectification – You have the right to request that any inaccurate data that is held about you is corrected, or if we have incomplete information you may request that we update the information such that it is complete.
- Right to erasure – You have the right to request us to delete personal data that we hold about you. This is sometimes referred to as the right to be forgotten.
- Right to restriction of processing or to object to processing – You have the right to request that we no longer process your personal data for particular purposes, or to object to our processing of your personal data for particular purposes.
- Right to data portability – You have the right to request us to provide you, or a third party, with a copy of your personal data in a structured, commonly used machine readable format.
- Right to withdraw your consent – Where our processing of your personal data is based on you having provided your consent, you have the right to withdraw such consent.
Please note that these rights are not absolute, and are subject to certain restrictions and exemptions. For example, the right to erasure of Personal Data will not apply where we have a legitimate reason to continue to hold such data. 9. Changes to this Privacy Notice and our Policies
We reserve the right to make changes to this Privacy Notice at any time without prior consultation. Any changes to this Privacy Notice will be flagged in writing so that you are always aware of what Personal Data we collect, how we use it, and under what circumstances, if any, we disclose it. If at any time we decide to use Personal Data in a manner significantly different from that stated in this Privacy Notice, or otherwise disclosed to you at the time it was collected, we will notify you by e-mail.
10. Making a complaint
If you have a complaint about the use of your Personal Data, please let us know as soon as possible. If you wish to make a complaint you may do so in person, by telephone, in writing and by email. Please be assured that all complaints received will be fully investigated. We ask that you supply as much information as possible to help our staff resolve your complaint quickly.
You also have the right to make a complaint at any time to the Data Protection Commission, 21 Fitzwilliam Square South, Dublin 2 DO2 RD28, Ireland; Tel 076 110 4800 or 057 868 4800. The Data Protection Commission is the Irish supervisory authority for data protection issues.
